Why this privacy statement?
We process your personal data for the benefit of our service provision. We attach great importance to your privacy and we will therefore treat these personal details confidentially and carefully. Personal data is processed in accordance with the legal provisions such as the Data Protection Act and, from 25 May 2018, the General Data Protection Regulation (also known as GDPR). We would like to further inform you about this in this privacy statement.
Applicability of privacy statement
This privacy statement provides information about the processing of personal data by or on behalf of Trail Treks LTD and only applies to the use of its customers’ personal data and visitors to the website www.brakeburn .com
This privacy statement does not apply to websites of third parties, such as websites or apps to which Trail Treks LTD refers on its website www.brakeburn.com and in its emails. Trail Treks LTD recommends that you consult the privacy policy of these third parties on the relevant websites.

How do we collect personal data?
Trail Treks LTD can receive information from you in the following ways:
- Directly from you: for example, by entering into an agreement with us, if you contact us by email, telephone or in writing, you place an order on our ecommerce website, register for activities, use a customer card or subscribe to our newsletter.
- Through our own website: for the purposes of carrying out, improvement and registration of our services, we collect various information through our website, web shop and customer card by the use of cookies, among other things.
- Through third parties: we may use the services of third parties. These third parties then act on behalf of Trail Treks LTD This privacy statement also applies to the data collected via these third parties when they act as processor for Trail Treks LTD. We are not responsible for the collection of data that does not take place on behalf of Trail Treks LTD. In this regard, we refer you to the privacy policy of these third parties.
What personal data do we collect?
Trail Treks LTD may process personal data about you because you use the services of Trail Treks LTD and/or because you provide it to Trail Treks LTD yourself when you fill in a contact form on the website. Trail Treks LTD can process the following personal data:
- Contact and account details, including name, address, telephone number, email address, date of birth, information about your home, garden, personal preferences, social media account(s) and any login details that you provided.
- We do not save payment and invoice details if you make an online payment via a third party such as PayPal. If you provide this information yourself to us in another way, for example, in writing or by email, it could be that it is stored.
- Website details – such as IP address, traffic and location data and information about the use of our website, web shop, customer card and digital newsletters.
- Information that you submit when you apply for a job with us, such as your CV, motivation and any related information.
For what purposes do we collect your personal data?
Trail Treks LTD uses personal data obtained in the first instance to carry out the agreement that we conclude with the customer in the context of offering products and services on our website, web shop and for internal administration. More specifically, we ask you to share your personal data with us for the following purposes:
- For the benefit of entering into, maintaining and improving the contractual relationship with its (potential) customers, or for improving the services and products.
- For the application and implementation of legal obligations.
- To make analyses regarding purchasing and visiting behaviour on the website, web shop and comparing this with other (similar) shops with which we have active or passive cooperation.
- To provide your personal promotions, offers, tips and information by email and/or post.
- To provide purchase related information such as user guides, usage tips, information, warranty certificates, purchase receipts and related products.

Trail Treks LTD may send newsletters by email. If you no longer wish to receive a newsletter, you can use the unsubscribe link at the bottom of the newsletter.
Personal data is not used for purposes other than those described above.
Mobile Terms of Service
The Brakeburn mobile message service (the "Service") is operated by Brakeburn (“Brakeburn”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Brakeburn’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Brakeburn through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Brakeburn. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Brakeburn or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Brakeburn mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
With whom do we share your personal data?
Trail Treks LTD may share your personal data with companies affiliated with Trail Treks LTD, its clients, subcontractors (such as processors) who provide services on behalf of us or carry out assignments, suppliers, government agencies and other business contacts.
Trail Treks LTD may be required to provide your details due to a statutory obligation on Trail Treks LTD and/or following requests from authorities.
Trail Treks LTD has taken the necessary organisational and contractual measures to ensure that personal data is processed and protected in line with European legislation.

How long do we keep your data?
Trail Treks LTD does not store your data longer than necessary for the implementation of the agreements and in any case no longer than 24 months after the agreement has been terminated, unless this is necessary to comply with a statutory obligation for retention.
The termination of an agreement in this case means the cancellation of a customer card or the unsubscribing of a newsletter. If you wish to have your data removed in full, you can submit a request for this (see below).
What are your rights?
You must ensure that Trail Treks LTD has the correct personal data. You can object to the use of certain data by Trail Treks LTD, or request your data for inspection, correction and/or removal of your (personal) data in writing to the e-mail address info@brakeburn.com. Upon written request, any corrections made by you will be processed. Trail Treks LTD will respond to your request as quickly as possible, but within four weeks.
Complaints about the use of personal data can be directed to Trail Treks LTD or to the legally competent institution in our country.
How do we secure your personal data?
Trail Treks LTD takes the protection of personal data very seriously and takes appropriate physical, administrative, organisational and technical measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification.
